HATMA ya Kamishna Msaidizi wa Polisi Abdallah Zombe na wenzake 12 itajulikana leo, wakati Jaji Salum Massati atakapotoa uamuzi wake kama washitakiwa hao wana kesi ya kujibu au la. Jaji atatoa uamuzi huo baada ya mawakili wa pande zote mbili kumaliza kutoa maelezo yao ya utetezi kuhusu kesi hiyo.
Washitakiwa ambao mahakama itaona wana kesi ya kujibu watalazimika kusimama kizimbani kujitetea ili kuepuka adhabu ya kifo. Kosa la mauaji kisheria adhabu yake ni kifo, hivyo uamuzi wa Jaji Massati atakaotoa leo ndiyo utakaoonyesha ni washitakiwa wapi wanatakiwa wajitetee na ni wapi watarudi kwao kwa furaha.
Mahakama inaweza kuwaachia washitakiwa wote kama itaona hakuna ushahidi mzito unaowafanya wajitetee au inaweza kuwaachia baadhi ya washitakiwa na wengine kulazimika kujitetea kwa kadri itakavyoona uzito wa ushahidi. Lakini pia mahakama hiyo inaweza kuamuru washitakiwa wote kuwa wana kesi ya kujibu, hali itakayowalazimu mmoja baada ya mwingine kutoa utetezi wake mwenyewe na ikilazimika kuita mashahidi ambao ni katika jitihada za kusaidia kumwepusha na adhabu ya kitanzi.
Wiki iliyopita, mawakili wa pande zote walijenga hoja kuishawishi mahakama kukubaliana na maoni yao, baada ya upande wa mashitaka kumaliza kutoa ushahidi wao. Wakati upande wa mashitaka unasisitiza kuwa Zombe na wenzake wana kesi ya kujibu, upande wa utetezi unadai hakuna ushahidi mzito unaowafanya washitakiwa hao wasimame kizimbani kujitetea.
Zombe na wenzake wanashitakiwa kwa mauaji ya Wafanyabiashara wanne ambao ni Ephrahim Chigumbi, Sabinus Chigumbi ‘Jongo’, Mathias Lunkombe na Juma Ndugu, ambaye alikuwa dereva wa teksi iliyokuwa ikitumiwa na wafanyabiashara hao katika shughuli zao. Washitakiwa wengine katika kesi hiyo namba 26/2006 ni Mrakibu wa Polisi Christopher Bageni, Mrakibu Msaidizi wa Polisi Ahmed Makele, F. 5912 Konstebo Noel Leonard, WP. 4593 Konstebo Jane Andrew, D. 6440 Koplo Nyangelera Moris na D. 1406 Koplo Emmanuel Mabula.

Wanadaiwa kutenda kosa hilo Januari 14, 2006 katika msitu wa Pande nje kidogo ya Jiji la Dar es Salaam. Washitakiwa walikana mashitaka hayo na wameendelea kuwa rumande tangu kesi hiyo ifikishwe mahakamani kwa mara ya kwanza Juni, 2006.
Inadaiwa kuwa siku wanayotuhumiwa kufanya mauaji hayo, washitakiwa waliwakamata wafanyabiashara hao na dereva bila vikwazo vyovyote katika maeneo ya Sinza Palestina. Kwa mujibu wa upande wa mashitaka, askari hao walidai kuwa marehemu hao walikuwa majambazi, wakati haikuwa kweli. Upande wa mashitaka unadai watu hao walikuja jijini kutafuta soko la madini waliyokuwa nayo.
Wakati wanakamatwa, wafanyabiashara hao walikuwa na kiwango kikubwa cha madini na fedha nyingi baada ya kuuza baadhi ya madini kwa mfanyabiashara mwingine Arusha ambako walikwenda kupeleka watoto wao shuleni. Inadaiwa kuwa washitakiwa wote kwa pamoja, walipanga mauaji hayo na baadaye kuhusisha tukio hilo na matukio mengine ya wizi wa kutumia silaha kwenye Kampuni ya Bidco na Al-Mar Jewellers Kariakoo ili kujaribu kujipatia madini na fedha za wafanyabiashara hao.
Upande wa mashitaka unadai pia kuwa askari walitekeleza mauaji hayo kwa kupokea amri kutoka kwa Zombe kwa usimamizi wa karibu wa Bageni na Makele. Inadaiwa pia kuwa washitakiwa (isipokuwa Zombe) waliwachukua marehemu hao hadi kwenye msitu wa Pande na kuwapiga risasi huku wakiwa wamewalaza kifudifudi. Baada ya mauaji hayo, washitakiwa wanadaiwa kukutana katika Kituo cha Polisi cha Urafiki ambapo waligawana pesa na vitu vingine wanavyodaiwa kuchukua kutoka kwa wafanyabiashara waliouawa.
Kesi hiyo ilianza kusikilizwa Mei 27 mwaka jana na upande wa mashitaka katika kuthibitisha makosa ya mauaji yanayowakabili washitakiwa hao ulipeleka mashahidi 37. Ushahidi wao ndiyo unaufanya upande wa mashitaka kuishawishi mahakama ione kuwa washitakiwa wote wana kesi ya kujibu kwa vile ndiyo walioshiriki kuwakamata washitakiwa na baadaye wakapatikana wameuawa.
Suala la marehemu kuuawa kwa risasi halina ubishi, ila swali la msingi ambalo mahakama inalazimika kujiuliza kabla ya kutoa uamuzi wake ni kama washitakiwa ndiyo walioshiriki kuwaua marehemu hao. Jambo lingine la kujiuliza katika kesi hiyo ni kama mauaji hayo yalifanywa wakati washitakiwa wote wakiwa na nia moja ovu ya kuua au walifanya hivyo kwa bahati mbaya. Katika kujenga kesi yao, upande wa mashitaka unadai ushahidi kadhaa unaonyesha kuwa washitakiwa ndiyo walioshiriki kuwaua wafanyabiashara hao kwani waliwakamata bila mapigano yoyote Sinza.
Upande wa mashitaka unadai kuwa washitakiwa walikuwa na nia ovu ya kuwaua washitakiwa hao kwani baada ya kutimiza kitendo hicho, waligawana fedha ambazo walikutwa nazo marehemu hao. Lakini upande wa utetezi unadai hakuna shahidi aliyeshuhudia kama washitakiwa ndiyo waliofyatua risasi kuwaua marehemu, ila ushahidi wote ni wa kimazingira na wa kusikia.
Zombe anakingiwa kifua na wakili wake kuwa hajawahi kuwaona marehemu kabla ya kuuawa na hata baada ya kuuawa hakuona miili yao. Wakili huyo pia anadai kuwa hakuna ushahidi unaothibitisha kuwa Zombe ndiye aliyeamuru watu hao kuuawa kwa risasi. Umma wa Watanzania una hamu ya kutaka kufahamu kile ambacho kitaamriwa na Mahakama Kuu ya Tanzania leo.

The Danish Ministry of Education Scholarship Scheme is open to highly qualified candidates studying for selected Academy Profession degrees or Professional Bachelor’s programmes. In this section you can find more details about the scheme.
What is The Danish Ministry of Education Scholarship Scheme?Denmark warmly welcomes highly qualified and motivated students from all over the world. A number of scholarships are therefore offered each year by the Danish Ministry of Education to fund students from countries outside the European Union/ European Economic Area. The scholarships can be awarded for a full degree programme or for part of a degree programme at undergraduate level. The minimum duration of a scholarship is one academic year and it is awarded for full-time studies only. The subject areas which are eligible for funding are listed below.
Who can apply for a scholarship?
In order to be eligible to apply for a scholarship you have to be:
*A citizen of a country outside the European Union (EU) and the European Economic Area (EEA).
*Permanently resident in a non-EU/EEA country.
*Studying in Denmark outside any established exchange programme or another kind of agreement, which waives your tuition fee.
Which academic disciplines are included in the scholarship scheme?The Ministry of Education each year decides which subject areas and study programmes are included in the scholarship programme. In 2009 the following programmes are included:

Academy Profession degree programmeAn Academy Profession (AP) degree programme normally lasts 2 years (120 ECTS credits). The programmes are offered at Academies of Professional Higher Education ( Erhvervsakademier ) throughout Denmark. AP degree programmes combine theory with practice and are suited to employment in business and industry. The qualifications also qualify graduates for further studies at universities.
Professional Bachelor's degree programme
Depending on the subject area, a Professional Bachelor's degree is awarded after 3 to 4½ years of successfully completed studies (180-270 ECTS credits). The programmes are offered at University Colleges ( Professionshøjskoler ). University colleges combine theoretical study with practical appli-cation in a range of subject areas. Study is based on a combination of lectures, seminars, project work and group activities. Work placements are always included in the programmes, which prepare you to enter specific professions. Most of the Professional Bachelor’s degrees also qualify graduates to apply for post-graduate studies.
What kind of financial support can I apply for?
The scholarship covers annual tuition fees and a maintenance grant towards your living costs. The grant is approximately DKK 5,000 (approximately 650 Euro) per month.
How and when do I apply?
If you would like to apply for a scholarship, we would strongly recommend you do the following:
1. Look at the list of subject areas included in the scholarship scheme to find an interesting study programme, which you are qualified to apply to.
2. Contact the institution which offers the specific study programme you are interested in. The institution will then provide you with the application form. The institution can also inform you about entry requirements, course descriptions, deadlines and student services.
3. Complete the application form and send it to the institution you are applying to. Guidelines are included on the application form. If you require further information or guidelines, please have a look at the template version provided by CIRIUS
4. Apply for a residence permit. Read the instructions below.
Please note that the deadline for applications at most institutions is in March (for entry the following academic year - August/September). However, please check with the institution you are applying to for exact dates.
When will I be notified about the outcome of my application?The institution will assess all applications and send a shortlist of candidates to CIRIUS – The National Agency for Internationalisation of Education and Training. CIRIUS and the Danish Ministry of Education will then undertake the final selection. As soon as this process is finalised, the applicants will be notified by the institution where they have applied for a scholarship
How do I apply for a residence permit?
The procedures vary depending on your nationality. Students from outside the EU/EEA should note that they have to apply for the residence permit in their home country. There are also certain financial requirements attached to the process. You can find more information about residence permit in English on the home page of the Danish Immigration Service .
What are my obligations if I am awarded a scholarship?
If you are awarded a scholarship, you are required to follow the programme that you have been awarded a scholarship for. It is not normally possible to transfer your scholarship to another institution. If you do not pass your exams, the scholarship will normally be suspended, except for in exceptional circumstances, e.g. illness, etc. You are also required to submit an annual report with an evaluation of your study experience and stay in Denmark
